Iran launches monkey into space

Last summer, the Iranian Space Agency announced their plan to send a monkey into space - and now they've apparently done it.

According to Iranian state-run television, a press release on the space agency's website, and photos of the event, Iran sent a live rhesus monkey into sub-orbital space aboard a small rocket called Pishgam, or Pioneer. There's even a video posted on YouTube that appears to be of the launch (though New Scientist could not confirm its authenticity).

The report has not been confirmed independently, however, and the US air force's North American Aerospace Defense Command (NORAD) has not reported seeing any missile launches from Iran.

But independent observers say the launch looks legitimate.

"Really, I see no reason not to take their word for it," says Jonathan McDowell, an astronomer at the Harvard-Smithsonian Center for Astrophysics who also keeps a log of space launches. He says he's convinced by the photos and discussions he's had with several knowledgeable source in online forums.

In photos released on the Iranian Space Agency's website, the rocket looks like the same kind the agency has launched before, but with a larger nose cone designed to fit a small chamber that can support life. Images also showed a live rhesus monkey strapped to a small seat.

The reports say the rocket went straight up 120 kilometres, which McDowell says qualifies as outer space, but not high enough to reach orbit, and came back down with a parachute.

It's unclear exactly when the launch took place. The press release says that the launch happened on the birthday of Mohammed the Prophet, which is celebrated by Shiites on 29 January, but was celebrated last week elsewhere in the world.

Some countries worry that Iranian rockets capable of carrying animals or people could also carry weapons. Iran has denied any military intention.

"This is not a scary thing because this is not a big new rocket that could hit America or anything like that," McDowell says. "There's nothing military to this. It's purely for propaganda. Nevertheless, it advances their science and their technology by being able to do it."

Iran says the launch is a first step towards sending humans into space, which they intend to do in the next 5 to 8 years. To do that, McDowell says, they'll need to build a larger rocket. The country currently has a vehicle called Safir that has successfully put satellites in orbit, and is developing a more powerful launcher called Simorgh.

The next step will probably be to either launch Safir to carry a human to sub-orbital space, or an unmanned Simorgh flight into orbit to make sure mission controllers can return it to the ground safely.

"They don't want to repeat what the Soviets did" in 1957, McDowell says, "which is put a living being in orbit before you figure out how to get it back."

Boy Scouts close to ending ban on gays

The Boy Scouts of America, one of the nation?s largest private youth organizations, is actively considering an end to its decades-long policy of banning gay scouts or scout leaders, according to scouting officials and outsiders familiar with internal discussions.

If adopted by the organization?s board of directors, it would represent a profound change on an issue that has been highly controversial -- one that even went to the US Supreme Court. The new policy, now under discussion, would eliminate the ban from the national organization?s rules, leaving local sponsoring organizations free to decide for themselves whether to admit gay scouts.

?The chartered organizations that oversee and deliver scouting would accept membership and select leaders consistent with their organization?s mission, principles or religious beliefs,? according to Deron Smith, a spokesman for the Boy Scouts? national organization.

Individual sponsors and parents ?would be able to choose a local unit which best meets the needs of their families,? Smith said.

The discussion of a potential change in policy is nearing its final stages, according to outside scouting supporters. If approved, the change could be announced as early as next week, after the BSA's national board holds a regularly scheduled meeting.

Only seven months ago, the Boy Scouts affirmed a policy of banning gay members, after a nearly two-year examination of the issue by a committee of volunteers convened by national leaders of the Boy Scouts of America, known as the BSA.

In a statement last July affirming the ban, its national executive board called it ?the best policy for the organization.?

But since then, a scouting official said, local chapters have been urging a reconsideration. "We're a grassroots organization. This is a response to what's happening at the local level," the official said.

Two corporate CEOs on BSA?s national board, Randall Stephenson of AT&T and James Turley of Ernst & Young, have also said they would work to end the ban. Stephenson is next in line to be the BSA?s national chairman. During the 2012 presidential campaign, both Barack Obama and Mitt Romney said the BSA should admit gay scouts and scout leaders.

Jennifer Tyrrell, who was ousted as a den mother for her son's Cub Scout troop because of her sexual orientation, is fighting back. Tyrrell talks to msnbc's Thomas Roberts about her petition to change the Boy Scouts of America's long-standing policy on banning gays and lesbians.

About 50 local United Way groups and several corporations and charities have concluded that the ban violates their non-discrimination requirements and have ceased providing financial aid to the Boy Scouts. An official of The Human Rights Campaign, an advocate for gay rights, said HRC planned to downgrade its non-discrimination ratings for corporations that continue to give the BSA financial support.

?It?s an extremely complex issue,? said one Boy Scouts of America official, who explained that other organizations have threatened to withdraw their financial support if the BSA drops the ban.

While the national scouting organization sets broad policies, more than 290 local councils nationwide govern the day-to-day conduct of the more than 116,000 local organizations. Individual scouting troops are sponsored by religious and civic organizations that represent a diversity of views on the issue of allowing gay scouts and leaders.

?The beliefs of the sponsoring organizations are highly diverse,? the official said.

The policy change now under discussion ?would allow the religious, civic or educational organizations that oversee and deliver Scouting to determine how to address this issue,? said the BSA's Smith.

?The Boy Scouts would not, under any circumstances, dictate a position to units, members or parents. Under this proposed policy, the BSA would not require any chartered organization to act in ways inconsistent with that organization?s mission, principles or religious beliefs,? he said.

In 2000, the U.S. Supreme Court concluded that the Boy Scouts had a First Amendment right of free expression when it came to the organization?s belief that homosexual conduct is inconsistent with values stated in the scout oath, requiring scouts to be ?morally straight.?

The Scouts have won similar legal battles, with courts finding that the BSA?s right of free association permits it, as a private organization, to reject those it believes do not conform to is values.?

Options market sees big move in Apple shares after earnings

NEW YORK/CHICAGO (Reuters) - The options market is bracing for a big move in Apple shares after it posts earnings on Wednesday, amid what has been a dramatic plunge for the world's most valuable publicly traded company.

Apple shares were trading at just around $500 on Tuesday, down sharply from $702.10 in September, on worries that its mobile devices are no longer as popular.

Based on options activity just hours before the announcement, traders were estimating about a 7 percent one-day move after the earnings, which would be a much more volatile outcome than normal for Apple. Such a move could push the shares as low as $465 or as high as $535, depending on how earnings come out.

"Three ingredients make this earnings for Apple especially appetizing for options traders: (CEO) Tim Cook has missed earnings estimates 60 percent of the time over the past five quarters, the stock has crashed almost 30 percent since September, and no stock has as many hedge funds owning it," said Gareth Feighery, a founder of options education firm Markettamer.com in Philadelphia.

"Combine those three factors together and Apple is a fireworks display ready to ignite, which makes it no surprise to see its options building in a move of close to 7 percent post-earnings."

In the previous eight quarters, the average one-day earnings move has been 3.9 percent, according to RiskReversal.com, an options research firm based in New York.

As competition intensifies from Samsung Electronics Co Ltd and others using Google Inc's Android software, investors are wondering if Apple's days of hyper growth are over.

Despite the sharp decline in recent months that cost Apple nearly $190 billion in market capitalization - about equal to the entire value of AT&T - plenty of Apple bulls remain on Wall Street, with about four-fifths of the nearly 60 analysts covering the company rating it "buy" or "strong buy," according to Thomson Reuters data.

The median price target on Wall Street is $745, which is roughly 50 percent above Apple's current stock price.

Dan Nathan, a co-founder of options research firm RiskReversal.com, expects a bounce in shares after results.

"The sentiment got too negative too fast, and expectations for Q1 and Q2 may be achievable and possibly even too low," he said. Nathan said the stock could rebound to about $550 before running into problems if Apple can "beat and dispel most of the rumors about either iPhone demand or production issues in the quarter, and guide in-line or a tad higher than Wall Street consensus."

Apple shares are trading at 9.8 times estimated forward 12-month earnings, a level that analysts say is unusually inexpensive for a company with its growth profile.

But some were more cautious, given the loss of momentum in the stock that had helped it hit records in September and drive the S&P's rally through the summer.

"While there is a bulk of activity in calls way out-of-the-money in prices like $520 and $550, there is also a lot of buying of the at-the-money puts at around $500", suggesting that the put buyers who are most likely to be Apple stock owners, are hedging against an immediate downside risk, said JJ Kinahan, chief derivatives strategist at TD Ameritrade.

Feighery noted that February weekly $510 strike calls expiring on the week of February 22 are cheaper than their equivalent puts, suggesting concerns about whether Apple can "bounce back short-term with conviction and maintain its gains."

Analysts on average estimate Apple's fiscal first-quarter earnings per share at $13.41, down slightly from $13.87 in the year-earlier quarter. Revenue is seen up 18 percent at $54.7 billion, according to Thomson Reuters I/B/E/S.

Wall Street estimates Apple sold between 47.5 million and 53 million iPhones, up considerably from the 26.9 million sold in the previous quarter, when the iPhone 5 had not made it to all markets. IPad sales are expected at 23 million to 25 million.

The complaint filed by the estate and four children of linebacker Junior Seau contains claims and allegations typical of the thousands of other concussion lawsuits.? For example, the lawsuit refers to the NFL?s glorification of violent play via videos sold by NFL Films, quoting Seau from a 1993 offering in which he says, ?If I can feel some dizziness, I know that guy is feeling double [that].?

But the lawsuit contains a lengthy and detailed explanation of the symptoms Seau suffered in the years prior to his death.? The complaint explains that, as early as the mid-1990s, Seau was demonstrating ?dizziness and other symptoms of concussion,? with a ?noted change in his behavior and functioning.?? He began, according to the lawsuit, to become ?erratic,? and he showed ?emotional instability.?? The complaints refers to persistent insomnia dating back to the mid-1990s, and contends that he became ?forgetful and unable to concentrate or focus.?

?Both at work and at home, people noticed that he could not remember their discussions, he misplaced things and forgot appointments,? the complaint alleges.

Seau also began to demonstrate ?self-destructive, aggressive and violent behavior,? along with ?severe depression,? during which episodes he became ?irrational and unreachable.?? He ?lashed out verbally and physically at his staff, friends, and family,? and he ?entered a devastating cycle of depression and alcohol abuse.?

The lawsuit further claims that he became ?a compulsive, manic gambler,? which led to ?gambling binges? resulting in the loss of ?significant amounts of money.?

While the timeline of the various manifestations of alleged brain damage isn?t clear, the fact that Seau began to show symptoms as early as the mid-1990s gives rise to an obvious question:? Why did he keep playing football?

Moreover, the long list of symptoms highlights one of the biggest challenges Seau?s lawyers will face.? Arguably, the NFL was fully aware of the risks of concussions in October 2009, once the NFL acknowledged the problem to Congress and began to make significant changes in the management of players who have suffered brain injuries.? If, at that point, Seau was exhibiting symptoms (and based on the lawsuit he clearly was), the two-year clock began to tick.? And, as the NFL surely will argue, it expired more than six months before his death.

?We were saddened to learn that Junior, a loving father and teammate, suffered from CTE,? Seau?s family said in a statement.? ?While Junior always expected to have aches and pains from his playing days, none of us ever fathomed that he would suffer a debilitating brain disease that would cause him to leave us too soon.?

This suggests that the Seau lawsuit will hinge on the argument that the window for filing suit didn?t open until Seau was diagnosed with Chronic Traumatic Encephelopathy, after his death.? While a court may agree, there?s a good chance that the case will be dismissed fairly quickly, under the argument that Seau was having cognitive problems years in advance, and that his deadline for filing a lawsuit expired before he died.

Gangnam Style, the most-watched YouTube video ever, with more than one billion views, by K-pop sensation Psy has generated $8 million revenue on YouTube alone, said Google chief business officer Nikesh Arora in a rare disclosure on the company?s fourth quarter earnings call. A?previous analysis?by the Associated Press indicated that Psy had earned $7.9 million from Gangnam Style in worldwide revenue, including downloads on iTunes and streaming and sales on services available only in Korea.

Considering that Gangnam style has, as of this writing, racked up 1.23 billion views on YouTube, that means the video is generating on average 0.65 cents every time someone plays the video. The creator of a YouTube video keeps about half of that money, which suggests Psy and his record company have earned about $4 million from YouTube.

Rape charge against Stuart Hall deepens BBC scandal

LONDON (Reuters) - A veteran British TV presenter was charged with rape and 14 counts of indecent assault on underage girls, police said on Tuesday, deepening concerns about sex abuse by top BBC personalities decades ago.

Stuart Hall, 83, best known for hosting "It's a Knockout" in the 1970s and 1980s, was questioned after late broadcaster Jimmy Savile was exposed last year as a serial child sex abuser, prompting a flurry of further sex crime allegations.

Hall, who was still appearing regularly on BBC radio until recently, had already been charged with three counts of indecent assault, in December. He denied all charges.

Hall was bailed to appear before magistrates in Preston, northwest England, on February 7.

The rape was alleged to have been committed in 1976 against a 22-year old woman, the police said. The indecent assaults were alleged to have been committed between 1967 and 1986 and to involve 10 girls aged between nine and 16 years.

There was no immediate comment by the BBC, Britain's public broadcaster whose director general was forced out of office by the Savile scandal.

Dear Diane,
There is a statute of limitations on all debts, including car loans. This statute varies based on the type of debt and from state to state. The clock on the statute of limitations starts ticking at the date of the last payment, so your daughter's debt probably isn't 19 years old unless she made just a few car payments. Still, the debt is probably old enough that the statute of limitations has passed and the collector can no longer sue. To find out the statute for your state, visit your state attorney general's website or contact a local attorney.

Even if the statute has passed, the collection agency is still allowed to contact you, though they can't sue you for nonpayment. You can send them a certified letter demanding that they stop contacting you. However, keep in mind that you still technically owe the debt. Nonpayment can still affect your credit score if the debt is still within the statute of limitations.

Boeing?s 787 woes test company?s reputation

Boeing's new-model 787 is receiving plenty of attention lately - but it's not at all the kind of buzz the aircraft maker had been hoping for with?an aircraft that carries such high hopes it was dubbed the "Dreamliner."

??Welcome to the age of social media, Boeing,? quipped Michel Merluzeau, managing partner with G2 Solutions and a longtime aviation analyst.

The FAA on Wednesday ordered that all new model 787 planes operating in the United States temporarily cease operations?until the FAA is sure that the batteries used in the new airplane are safe. Although the FAA commonly issues airworthiness directives to deal with specific problems, experts say it's rare that the agency takes the extra step of ordering airplanes to stop operating pending a check.

?This is really a very unusual step,? Merluzeau said.

The action came after two serious issues involving the airplanes? batteries raised concerns about fires?inside?the?aircraft. It also follows?a series of other mishaps?in the?past few months that earlier had prompted a broader FAA review of the aircraft model. No one has been hurt in the incidents.

Aviation experts maintain that brand-new airplane models like the 787 are bound to have some growing pains, and most?still believe the airplane will be a success in the long-term. But some?say that the images of firefighters surrounding the aircraft and passengers bouncing off emergency slides are bound to raise alarm bells with some flyers.?

??The aviation community recognizes that Boeing will eventually fix the 787 and anticipate it to be a fine airplane, eventually,? Scott Hamilton, an aviation industry consultant with Leeham and Co., said in an e-mail Thursday. ?The flying public won't be so forgiving in the near-term.?

Even among the aviation community, some say that there could eventually be a limit?to how long customers and industry watchers will be forgiving.

?Boeing is kind of running out of (opportunities) to argue that this is a normal teething issue,? Merluzeau said.

Analysts said the company could likely overcome the current threats to the airplane model's reputation if it can address the issues quickly. That's because most flyers don't pay attention to what airplane they are getting on, as long as they are getting a good price for their ticket.

"You're either afraid of flying or you're not - that's basically what it comes down to," said Richard Aboulafia,?vice president of analysis with Teal Group.

Nevertheless, Aboulafia said that Boeing had likely hoped at this time to be raising excitement and buzz around being the first to fly the 787, rather than responding to FAA directives. Boeing also?has touted the 787 as a superior passenger experience because of bigger windows, better lighting and a more humid cabin.

"This is?a kind of buzz wave that manufacturers like to catch upfront," Aboulafia?said.

The 787, which entered service in the fall of 2011, is groundbreaking because it is made largely of light composite materials instead of aluminum, and it relies largely on electric systems instead of hydraulics.

Aviation experts say the 787?s systems mark major technological advancements for aviation, but using such a large number of new technologies also is risky.

Boeing delivered the first 787 more than three years late, in part because of difficulties working with a vast web of suppliers who designed and built key components for the new aircraft. Hamilton, of Leeham, said the distraction of the 787?s woes also have kept the aircraft maker from moving forward with other new airplane designs as quickly as many would like. That could be competitive problem for them down the road.

Boeing has received 848 orders for the 787. It has delivered 49 of the aircraft, according to the aircraft maker?s website.

United Airlines is the only U.S. carrier that is currently operating the 787. The carrier said in a statement Wednesday that it was working with?the FAA and Boeing toward restoring service and would accommodate customers on other airplanes in the interim.

Boeing Chief Executive Jim McNerney said in a statement Wednesday that the company was working around the clock to address the issues.

"We are confident the 787 is safe and we stand behind its overall integrity,? McNerney said in the statement.

Syria: Twin suicide blasts hit south of Damascus

(AP) ? Two car bombs exploded in southern Syria and a rocket slammed into a building in the north in a spike in civil war violence Friday that Syrian state media blamed on rebel fighters trying to topple President Bashar Assad.

The rocket attack in the northern city of Aleppo and the suicide car bombings in Daraa, south of Damascus, occurred during a particularly bloody week nearly two years after an uprising began against Assad's regime. On Thursday, opposition activists said pro-government militia swept through a town in central Syria, torching houses and killing more than 100 people.

Both sides have been blaming each other for the recent attacks, and it was the second time in a week that the government accused rebels of firing rockets.

The state-run SANA news agency said the morning attack in Aleppo was carried out by terrorists, a term the regime uses for rebels. But the Local Coordination Committees of Syria, an activist group, and the Aleppo Media Center, a network of anti-regime activists, accused the government of launching an airstrike.

On Tuesday, 87 people were killed in twin blasts at Aleppo University. The regime said rebels hit the university with rockets. Rebels said the deaths resulted from regime airstrikes.

Syria's state-run TV claimed that shortly after the rocket hit the building in Aleppo, militants linked to an al-Qaida group detonated cars filled with explosives near a mosque in Daraa as worshippers were leaving following Friday prayers.

Video broadcast on Syrian state TV showed several floors of the targeted building collapsed in a government-controlled area of Aleppo, Syria's largest urban center and main commercial hub. The video showed a man carrying a baby out of the damaged building and another man was seen clutching his head as blood ran down his forehead. Residents were also seen looking for people buried in the rubble. At least one injured person on a stretcher was seen being carried away in a Red Crescent ambulance.

State TV reports said both attacks caused many casualties, but it was not immediately known how many people were killed or wounded in the two cities ? both major fronts in the civil war.

Government troops and rebels have been locked in a deadly stalemate in Aleppo and other areas in the north since last summer. Six months later, the rebels hold large parts of the city. Still, they have been unable to overcome the regime's far superior firepower.

With the two sides deadlocked on the northern front, rebels have increasingly targeted state security facilities and government institutions in other parts of the country, including in the capital, Damascus. Suicide attacks have been a hallmark of the Islamic rebel units that have been fighting alongside other opposition fighters.

State TV said fighters with Jabhat al-Nusra, a group the U.S. has declared a terrorist organization, were behind the twin blasts in Daraa.

Daraa is the birthplace of the revolt that erupted in March 2011. It began as peaceful protests against Assad's rule but quickly turned into a civil war after a brutal government crackdown on dissent More than 60,000 people have been killed in the violence, according to a recent United Nation's estimate.

Also on Friday, fighting between Syrian rebels and Assad's loyalists flared in a Palestinian refugee camp in Damascus, killing 12 people and wounding at least 20 others, a U.N. refugee agency said. Children were among the casualties, according to a statement issued by the U.N. Relief and Works Agency. The agency called on both sides to "pull back from civilian areas, including refugee camps."

The Palestinian camp called Yarmouk has been the scene of heavy clashes between rebels and regime loyalists since mid-December, when opposition fighters moved into the camp during an attempt to storm the capital.

About half of Yarmouk's 150,000 residents have fled since fighting erupted in mid-December, according to UNRWA, which administers Palestinian camps in the Middle East. Some sought refuge in neighboring Lebanon, and others found shelter in UNRWA schools in Damascus and other Syrian cities.

Dozens have been killed in the fighting, although the United Nations did not provide an exact figure of casualties in Yarmouk violence, which has included airstrikes and artillery shelling from the Syrian military.

Use an App to Diagnose Skin Cancer? Not a Good Idea, Study Says

Smartphone applications that use pictures of users? skin to determine if they have deadly skin cancer are not accurate and should generally be avoided, a new study led by the University of Pittsburgh says.

The most accurate of three applications that use mathematical algorithms to scan suspected cancerous lesions missed 18 out of 60 deadly melanomas, the study shows.

?That?s a pretty big risk to take,? says lead author Laura Ferris, Ph.D.

Technically, the applications are marketed as educational only, meaning that they aren?t registered as medical devices nor regulated by the Food and Drug Administration, Reuters reported Jan. 16. Many users, however, may not realize this.

?We?re all for technology, but we need to keep it in perspective,? says Karen Edison, a dermatologist from University of Missouri in Columbia. If a user suspects the a lesion might be cancerous they need to go to the doctor, regardless of what an app tells you.

?There?s no substitute, at this point, for a complete skin exam performed by an expert dermatologist for picking up melanoma as well as other skin cancers,? Edison says.

The study appears online in the journal JAMA Dermatology.

Los Angeles, CA (January 15, 2012)- Studies have shown that women are less likely to take the most direct approach to ensure that they receive fair pay compared to their male counterparts simply asking. So what happens when women begin to negotiate for higher salaries? Could women begin to close the gender pay gap simply by learning to negotiate for more money?

A new study finds that women can successfully negotiate higher salaries, but unlike men, they have to pay attention to the approach they use in order to avoid social backlash. This study was published in Psychology of Women Quarterly (a SAGE Journal).

"The anticipation of social backlash or pay discrimination is taxing for women and undermining of their human potential," stated the study authors Hannah Riley Bowles and Linda Babcock.

In part one of their study, Bowles and Babcock surveyed 402 participants who were asked to watch a video in which a recently-promoted female employee negotiated her new salary. In some of the videos, she expressed a concern for her relationship with her manager, for example by including phrases such as "I hope it's OK to ask you about this" and "My relationships with people here are very important to me," in others she negotiated her salary while alluding to another offer she had received, while in others, she did both. The survey participants were then asked to answer a series of questions about whether they would enjoy working with the woman and whether or not they would grant her the salary she desired.

After analyzing survey results, the researchers found that alluding to another offer increased the likelihood that the women would get the pay desired and that showing concern for business relationships helped to mitigate social backlash. However, combining these strategies was not successful and did not avoid social backlash

In part two of their study, the researchers surveyed 177 college-educated Americans with work experience. Like part one, the participants were asked to view short episodes in which female employees negotiated their salaries using different techniques. Additionally, the participants watched male negotiators use the same negotiation scripts. The survey participants were then asked to rate their willingness to work with the negotiators (both male and female) as well as their willingness to grant their compensation requests.

The researchers found that when the study participants watched episodes in which female negotiators legitimized their compensation requests and communicated concern for organizational relationships, the participants found the women to be more relational, found their requests for compensations to be more legitimate, and did not socially punish the women for having negotiated. Conversely, the men who expressed the same relational concern as they negotiated were not more successful than when they used a direct negotiation approach.

The researchers called for further research that will take into account both monetary outcomes of women who negotiate for higher compensation as well as the social and relational factors that might affect compensation negotiation.

"While gender constraints are real, they are not inescapable," the authors continued. "We expect men to be in charge because they are, and we expect men to earn more because typically they do every woman who reduces the gender gap in pay and authority reforms the social structures that keep women in their place."

MacDonnell on the Pretrial Right to Counsel in Canada

Vanessa MacDonnell?(University of Ottawa - Faculty of Law (Common Law)) has posted?R v. Sinclair: Balancing Individual Rights and Societal Interests outside of Section 1 of the Charter?(Queen's Law Journal, Vol. 38, No. 1, 2012, pp. 137-64) on SSRN. Here is the abstract:

The majority judgment in R v Sinclair reflects what the author sees as a problematic trend in the Supreme Court of Canada?s pre-trial legal rights jurisprudence under the Canadian Charter of Rights and Freedoms. In Sinclair, the Court took the novel step of holding that society?s interest in ?the investigation and solving of crimes? should be taken into account in determining the scope of the right to counsel under section 10(b). The author explains that such interests are usually left to the justification stage under section 1 of the Charter, but that section 1 is functionally unavailable in the context of many pre-trial legal rights claims. This is because in cases of alleged police misconduct, the state action in question is not authorized either by statute or by common law, so the section 1 requirement that the limits on rights be prescribed by law cannot be met. For this reason, the author argues, courts have sought other ways to incorporate interest balancing into Charter analysis. In some cases they have done so under the ?fundamental justice? proviso to section 7, and in others by expanding police authority under the ?ancillary powers doctrine?.

The author situates the Sinclair decision within the overall jurisprudence on section 10(b), and argues that the Court wrongly imposes an internal limit on section 10(b) in a manner that avoids the rigorous constraints that the Oakes test imposes on the section 1 analysis. The author?s overall conclusion is that Sinclair reflects a judicial encroachment on the role of the legislature and a weakening of the role of the courts as defenders of fundamental rights.

Immigrant Groups Welcome California DMV Report On Unlicensed Drivers

SACRAMENTO (CBS/AP) ??Immigrant advocates are welcoming a California study that found unlicensed drivers are the most hazardous motorists on the road, saying it supports their longstanding argument that denying driver?s licenses for illegal immigrants has put everyone at risk.

Drivers without a valid license are nearly three times more likely to cause a deadly crash, according to the Department of Motor Vehicles report.

The study reviewed drivers with revoked or suspended licenses along with unlicensed drivers who were found to have the worst driving record.

Advocates say immigrant drivers could benefit from training and testing required to get a license. Opponents, however, say a driver?s license would jeopardize national security by giving illegal immigrants an official ID from the government.

The study came as the debate over driver?s licenses for illegal?immigrants has been heating up. Illinois is expected to join New?Mexico and Washington by becoming the third state in the U.S. to?grant driver?s licenses to illegal immigrants.

California Gov. Jerry Brown signed a bill last year offering driver?s licenses to young immigrants who qualify for two-year federal work permits.

Immigrant advocates say the California DMV findings show the issue should not get lost in the political discussion regarding immigration.

Licensed drivers provide a guarantee they have learned the rules of the roads in California and have been tested on them, said Pedro Rios, director of the San Diego office of the American Friends Service Committee.

?It makes sense that it would translate to fewer accidents leading to fatalities and ultimately I think that?s what everyone would want,? Rios said. ?It certainly would increase the number of drivers who would be insured and increase the ability for people to file claims when that?s necessary.

?It?s ultimately a public safety issue,? he added.

The actual number of unlicensed drivers in California is unknown?because they do not come to the attention of the DMV until they are involved in a crash or convicted of a traffic violation, according to the study, which was officially announced by the DMV on Dec. 20.

While little is known about them, the study says it is likely the percentage of illegal immigrants in this group increased after California passed a 1994 law requiring applicants to show a valid Social Security number and documents proving they are in the country legally.

The Los Angeles Times on Wednesday was the first to report that immigrant groups pushing to change the 1994 law believe the study supports their efforts.

It?s the DMV?s first significant analysis of unlicensed drivers in 15 years. The study used crash data over a 23-year period and looked at two-vehicle fatal crashes in which only one driver was at fault.

Supporters of the 1994 law said it is contradictory to reward illegal immigrants with a government document such as a driver?s license.

California Assemblyman Tim Donnelly, R-Twin Peaks, said ?it is not surprising that people driving on our roads with no operational familiarity of our roads and sign system would be the most hazardous drivers.?

But Donnelly added a California driver?s license ?is not simply a statement about someone?s driving ability, but a gateway ID that allows people to board planes, sign up for taxpayer funded aid, and register to vote.?

?Handing out this secure form of ID to people who have no legal right to be in our country presents a statewide and national security threat, the likes of which we went to great lengths to prevent after September 11th,? he said in an email to The Associated Press. ?We cannot hand it out like a teenager?s driving permit; it stands for much, much more.?

The DMV recommended vehicle impoundment and other measures to address the issue but did not discuss the debate over giving driver?s licenses to illegal immigrants.

The study?s author Sukhvir Brar said the DMV decided to look at accidents related to drivers without a valid license because it had not done so since 1997 and felt it was time to provide updated results. Brar said the composition of that driver population, and their risks, can change over time, so it is important to periodically assess risks.

Report: Mark Sanford to Run for Congress

Second chances do exist in politics, and Mark Sanford might just try his hand.

According to The Weekly Standard, the disgraced former governor of South Carolina will run for Congress. South Carolina will stage a special election in May to replace Senate fill-in Rep. Tim Scott, who was plucked from the lower chamber by Gov. Nikki Haley to replace Sen. Jim DeMint, who left to run the Heritage Foundation.

The main event for this deep red district will be the March 19 primary. The Weekly Standard's Michael Warren writes:

Mark Sanford, the former governor of South Carolina, will run for the House of Representatives, sources close to Sanford confirm. ?

Sanford, a Republican who held the House seat himself from 1995 to 2001, will announce his intention to run early next week, ahead of the Jan. 18 filing deadline.

Jenny Sanford, the former governor's ex-wife, on whom he famously cheated with a journalist in Argentina while claiming to be hiking the Appalachian Trail, has been rumored to be interested in running for the seat herself - along with a handful of area Republican politicians considered as likely or semi-likely to jump in.

The 1st District special election will be the first federal race after November 2012, and, as such, it may draw outsized interest from analysts and political obsessives seeking a referendum on the future direction of the Republican Party after its 2012 losses. But with Sanford in the race, it could be more of a character-driven soap opera than a reflection of a political moment.

Texas Lt. Gov.: Fund weapons training for teachers

AUSTIN, Texas (AP) ? Texas Lt. Gov. David Dewhurst called Friday for state-funded, specialized firearms training for teachers and administrators to guard against school shootings.

Dewhurst, a Republican, said school districts would nominate who they wanted to carry weapons on campus. The training would be more extensive than what is currently required for a Texas concealed handgun license and include how to react in an active shooter situation.

"God forbid we should have an active shooter crisis in our schools," Dewhurst said.

His proposal came in the aftermath of last month's mass shooting at an elementary school in Newtown, Conn., where a gunman slaughtered 20 children and six adults before killing himself. Vice President Joe Biden has been meeting with groups this week to develop policy recommendations on how to prevent such tragedies.

The National Rifle Association has called for armed guards in every school in America and rejected any further restrictions on gun purchases or ownership.

Dewhurst said the eight hours of class instruction and two hours of shooting training for a concealed handgun license is "not sufficient" for school employees.

"It doesn't teach how to respond emotionally and technically" to a potentially chaotic situation where young lives could be at stake, he said.

Dewhurst has a concealed handgun license and made his comments in a speech to the conservative Texas Public Policy Foundation.

He didn't provide any other details of his plan or specifics on what the training should include. He said the amount of state funding needed would depend on the number of school districts that participate and how many people want the training. School districts would not be required to participate.

Clay Robison, spokesman for the Texas State Teachers Association, said the state should spend more money on classroom instruction, not firearm instruction for teachers. The money Dewhurst is talking about would be better spent on equipping armed school security guards, he said.

"Teachers sign up to teach, not to be armed security guards in their classrooms," Robison said. "Even well-trained security guards with pistols are going to be at a disadvantage to a suicidal maniac with an assault rifle."

The prospects for his proposal weren't immediately clear. A spokesman for Sen. Joan Huffman, of Houston, leader of the Senate Republican Caucus, said she could not comment on Dewhurst's plan and its chances of passing the GOP-dominated chamber until the caucus meets next week.

Texas is a state where gun ownership is typically embraced. Concealed handgun license holders are allowed to bring weapons into the state Capitol and don't have to pass through security metal detectors.

Although state law generally bans guns from schools, school districts may grant teachers and staff permission to carry weapons on to campus if they are licensed.

But lawmakers don't pass every gun bill that gets proposed. In 2011, most of the state's lawmakers signed on in support of a bill allowing concealed weapons into college classrooms, but the bill failed without a final vote in the Republican-majority House.

Dewhurst said his plan would not be a mandate for more guns in schools, but would allow school districts to seek the state's help in guarding against a mass shooter.

Texas Gov. Rick Perry has said concealed handgun license holders should be allowed to carry their weapons wherever they want. Perry has a concealed handgun license.

Perry spokeswoman Catherine Frazier said Perry has called on schools to review emergency plans and "supports having a conversation during the legislative session about what we can do to strengthen school safety."

The Harrold Independent School District near the Oklahoma border is one of the few in Texas that allows school personnel with concealed handgun licenses to carry their weapons to school. The teachers and staff must first be approved by the school board and also take additional training on shooting accuracy, hostage situations and how to clear a classroom in a program designed for the school district.

Harrold schools Superintendent David Thweatt said he's heard from many Texas school districts about his program since the Newtown shootings. He said the program is cheaper than paying for an armed security guard.

"I'm getting a lot of calls from around the state," said Thweatt, who created his district's Guardian Plan in 2007.

"I think it's a good idea," Thweatt said of Dewhurst's idea. "One of the biggest objections to firearms in society is that some don't want people with that tool without some kind of extra training."

Hearings, trial closed in Indian rape case

NEW DELHI (AP) ? An Indian magistrate ruled Monday that the media will not be allowed to attend pre-trial hearings or the trial of the five men accused of raping and killing a young student in the Indian capital, a police official said.

Magistrate Namrita Aggarwal upheld the prosecutor's request that the media be barred from attending the proceedings, according to police spokesman Rajan Bhagat. Hundreds of journalists, lawyers from other cases and curious onlookers had crowded the courtroom where the five were to appear. Outside the courthouse complex, more than a dozen TV satellite trucks jammed the streets, and dozens of reporters ? from India, the U.S., Japan and elsewhere ? were waiting for news.

The Monday hearing was expected to result in the case being sent to a special "fast-track" court. Indian courts are notoriously slow, with some cases dragging on for decades. The trial is expected to begin in the coming days. Indian rape trials are normally closed to the media.

Authorities have charged the men with murder, rape and other crimes that could bring them the death penalty. The crime caused nationwide outrage, leading to massive protests.

A sixth suspect, who is 17 years old, is expected to be tried in a juvenile court, where the maximum sentence would be three years in a reform facility.

Prosecutor Rajiv Mohan said last week that a DNA test confirmed that the blood of the victim matched blood stains found on the clothes of all the accused.

On Sunday, two of the defendants offered to become "approvers," or informers against the others, according to reporters present at the hearing. The two were presumably seeking lighter sentences.

The companion of the student recounted in a television interview last week how the pair was attacked for 2 1/2 hours on a New Delhi bus before being thrown on the side of the road, where passersby ignored them and police debated jurisdiction issues before helping them. The student died at a Singapore hospital weeks after the Dec. 16 attack.

Indian law prohibits the disclosure of victims' identities in rape cases. While neither the companion nor the TV network, Zee News, identified the woman, police opened an investigation into Zee News after the interview was broadcast, saying too many details about the attack had been revealed.

The attack has led to calls for tougher rape laws and reforms of a police culture that often blames rape victims and refuses to file charges against accused attackers. The nation's top law enforcement official said the country needs to crack down on crimes against women.
